He (and probably his wife) should have just avoided the 'will' issues.

Chan gets more time over assets by Eddie Luk
Friday, February 10, 2012

The High Court has given fung shui practitioner Tony Chan Chun-chuen another two weeks to disclose his assets.

Chan, aged 52, owes the administrator of the estate of late Chinachem chairwoman Nina Wang Kung Yu-sum HK$130 million in legal fees.

On Monday, Chan was ordered to hand HK$65 million to the court by March 1.

At a hearing yesterday, the lawyer for Chan said his client had originally planned to remortgage his residential property on Bowen Road, which is estimated to be worth more than HK$500 million, to settle his legal fees.

But, owing to an injunction freezing some of his assets, Chan was unable to sell or remortgage.

Time runs out for Chan over $340m tax bill

The Court of Appeal has overturned a ruling that gave Tony Chan Chun-chuen more time to object to claims of around HK$340 million by the Inland Revenue Department.

The unanimous decision by Court of Appeal judges - Peter Cheung Chak- yau, Michael Hartmann and Johnson Lam Man-hon - means the fung shui master will now have to pay up unless he appeals to a higher court.

He was also ordered to pay costs.

In handing down the verdict, Justice Cheung said although Chan claimed he did not receive the assessments from the IRD, he has the responsibility under the current taxation ordinance to notify the department in order to get replacement forms.

The court also said a lack of knowledge of the notices is not a reasonable excuse and Chan should have made effective arrangements for them to be forwarded to him.

Last June, Court of First Instance judge Anselmo Reyes said Chan, 52, should be given more time as he claimed he had not seen the documents until it was too late.

However, in a subsequent appeal, the IRD sought to overturn the court ruling.

Chan stay call on `tampered proof'

Tony Chan Chun-chuen has asked that the forgery case against him be dropped on grounds that the evidence has been tampered with beyond recognition.

The self-styled fung shui guru was arrested and charged with forgery last year after he lost the high-profile probate battle for the HK$100 billion estate of late Chinachem tycoon Nina Wang Kung Yu- sum, who Chan claimed was his lover.

Ruling the will presented by him as fake, the High Court in February 2010 granted the Wang billions to the Chinachem Charitable Foundation - run by her siblings.

But defense lawyer Alan Hoo Hong- ching told an Eastern Court magistrate that key evidence, including the 2006 "fake" will and its draft, has been tampered with by fingerprint and DNA tests ordered by the prosecution.

"It is a completely different document now," Hoo said on day two of a pre- trial hearing and argued for a permanent stay as "a fair trial is no longer possible."

Tony Chan must pay fortune in legal fees

Fung shui practitioner Tony Chan Chun-chuen must pay HK$230.5 million in legal costs to the Chinachem Charitable Foundation, the manager of the late Nina Wang Kung Yu-sum's estate and to the secretary for justice.

The Court of Final Appeal set the amount after Chan lost all his appeals.

Of the sum,HK$130 million will go to the probate manager, HK$95.5 million to the Chinachem charity and HK$3 million to the secretary for justice.

The Court of Final Appeal's acting registrar, Simon Kwang Cheok-weung, ruled yesterday that Chan has to pay an additional HK$2 million legal fee to the Chinachem charity.

A source said the foundation applied to the High Court on June 20 asking Chan to pay HK$40 million as part of its legal fees, and would ask for a bankruptcy order against Chan if he failed.

Chan was also said to have found a buyer for his luxury property in Wan Chai for HK$400 million - HK$100 million less than market price - with which to pay the legal costs.

The Court of Final Appeal ruled in April last year that the 2006 document that Chan claimed was Wang's will - leaving her entire fortune to him - was a forgery.

Wang, the former Chinachem chairwoman and Asia's richest woman, died of cancer in 2007.
