homosexuality is thoroughly scorned by the Muslim community... whether it is true that anwar was involved in any homosexual activities, who really knows...but the intent to bring him down from politics was certainly and extremely vicious...

.........Kuala Lumpur (The Star/ANN) - The Federal Government of Malaysia has succeeded in its attempt to intervene in the breach of contract and constitutional suit filed by the Kelantan state Government against state oil giant, Petronas, over oil royalty.

High Court judge Justice Zabariah Mohd Yusof allowed the application after hearing submission by Senior Federal Counsel Datin Azizah Nawawi from Attorney-General's Chambers who acted for the Federal Government and lawyer Tommy Thomas for the Kelantan state government in chambers on Tuesday.

Counsel Rishwant Singh and Cecil Abraham, who represented Petroliam Nasional Bhd (Petronas), had no objections for the intervener application.

Speaking to reporters later, Rishwant said that Federal Government would now be named as the second defendant in the suit.

SFC Azizah said she had argued that petroleum obtained beyond three nautical miles from Kelantan shore belonged to the Federal Government.

"Kelantan is asking for petroleum won and saved in borders off Thailand and Vietnam which is beyond three nautical miles limit, which the Federal Government says belongs to it. The judge allowed the (intervener) application as we argued it is our interest," she added.

In the intervener application, the Federal Government said that all disputed aspects could be deliberated and decided effectively if it was added as the second defendant.

Besides that, the Federal Government said it would be fair for all questions and issues of law raised in the claim to be decided between the Malaysian Government and Petronas.

Rishwant said that the judge has set March 31 to hear an application by Kelantan state government to transfer the suit from the civil court to a commercial court.

He also said he was not aware of the reason the suit was fixed before the civil court when it was originally filed at the High Court (commercial) registry last year.

"The Kelantan state government will decide whether to proceed with this transfer application on the same day," he added.

In the suit filed on Aug 30 last year, the Kelantan state government said that Petronas had failed to make cash payments, which it claimed rightfully belonged to Kelantan for petroleum won and obtained offshore since 1998.

It said Petronas, named as sole defendant, had breached the Petroleum Development Act (PDA), the Kelantan Petroleum Agreement (KPA) and Kelantan Grant, for failing or refusing to make cash payments to the Kelantan government for petroleum won and obtained off Kelantan.

The claim stated that Petronas should make yearly cash payments equivalent to 5% of the value of the petroleum won and saved onshore and offshore Kelantan and sold by Petronas, its agents or contractors, to the Kelantan government.

The plaintiff claimed that despite failing to make the said cash payments, Petronas wrongfully continued to win and obtain petroleum off Kelantan.

Such conduct on the part of Petronas, it claimed, constituted unfair discrimination that resulted in severe financial loss to the state government and would continue to do so.

The plaintiff is seeking an inquiry requiring Petronas to make full and truthful disclosure of all relevant facts relating to the cash payments payable to Kelantan.

The plaintiff is also asking for an order that all arrears of cash payments be paid to Kelantan within a month of the court order, as well claiming for damages, interests, costs and further relief deemed fit by the court.

petronas is malaysia... what's the difference here? i guess, malaysia is probably setting a precedence to claim oil from private companies who drill outside their permitted territories...

I think it's because Kelantan is Opposition controlled :P
